John Mayo’s latest article in the Network Law Review, “New Insights into the Evolution of Judicial Standards in U.S. Merger Cases,” offers a digestible overview of his broader research, where he and his co-authors explore the evolution of judicial standards in U.S. merger trials. Contrary to the belief that courts have become more lenient due to the influence of the Chicago School, Mayo and his co-authors’ empirical analysis—based on data from over 77,000 mergers reported between 1982 and 2021—reveals that judicial standards have actually become stricter, with fewer litigated cases and higher success rates for antitrust agencies.
